1. Introduction

Welcome to Looming, an AI-powered fashion design SaaS platform operated by Fashion Node Studio. By accessing or using our service, you agree to be bound by these Terms of Service.

2. Service Description

Looming provides AI-powered tools for fashion design, including image generation, style transfer, pattern creation, and design workflow management. The platform enables designers to create, iterate, and export fashion designs using artificial intelligence.

3. User Accounts

• You must provide accurate and complete registration information.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 16 years of age to use the service.
• One person or entity may not maintain more than one account.
• You are responsible for all activity that occurs under your account.

4. Subscription and Payment

• Paid subscriptions are billed on a recurring basis (monthly or annually).
• Domestic WeChat Pay payments may be processed by Xunhupay or another local payment provider.
• International card, PayPal, or Apple Pay payments may be processed by Paddle.com where available.
• Payment processors handle payment collection, receipts, and applicable tax or compliance records for their channel.
• Prices are displayed inclusive of applicable taxes where required by law.
• You may cancel your subscription at any time; access continues until the end of the current billing period.
• Refund eligibility, guarantee windows, payment-channel handling, and cancellation details are described in our Refund Policy.

5. Intellectual Property

• Your Content: You retain full ownership of all designs, images, and content you upload or create using Looming.
• Upload Authorization: You represent that you have the rights, licenses, permissions, and releases needed to upload, process, edit, transform, export, and commercially use the content you submit.
• Permission to Process: You grant Looming the limited permission needed to host, transform, analyze, generate from, store, display, and export your uploaded content only to provide the features you request, maintain your workspace, process support requests, and operate account-scoped design memory.
• AI-Generated Content: You are granted a perpetual, worldwide, non-exclusive license to use, modify, and commercialize AI-generated content created through your use of the platform, subject to these Terms, the rights in your inputs, and the terms of any third-party AI provider used for that generation.
• No Exclusivity Guarantee: AI outputs can be similar to outputs generated for other users or by other services. Looming does not guarantee that any AI output is unique, exclusive, trademark-clear, copyright-clear, or suitable for registration without your own review.
• Commercial Use: Commercial use is permitted only where you have cleared the required rights in your inputs, outputs, brand assets, models, third-party references, copyright, trademark, publicity rights, and applicable provider or marketplace rules. You are responsible for reviewing AI-generated content before publication, manufacture, sale, or client delivery.
• Your Rights Clearance: You are responsible for confirming that uploaded references, logos, characters, brand assets, textile artwork, and other materials are owned by you or licensed for your intended use.
• Platform IP: The Looming platform, its code, design, and branding remain the intellectual property of Fashion Node Studio.

6. Acceptable Use Policy

You agree not to use Looming to:

• Generate content that is illegal, harmful, or violates the rights of others.
• Create deepfakes or non-consensual imagery of real individuals.
• Produce content that promotes violence, hatred, or discrimination.
• Infringe upon copyrights, trademarks, or other intellectual property rights.
• Upload or request protected logos, brand marks, recognizable commercial products, or copyrighted artwork unless you have the necessary rights and permissions.
• Attempt to reverse-engineer, exploit, or disrupt the platform.

7. Third-Party Providers and Trademarks

Looming may interoperate with or reference third-party providers, models, file formats, marketplaces, payment providers, or design tools such as Cloudflare, Xunhupay, Paddle, fal.ai, SiliconFlow, OpenAI-compatible APIs, Replicate, APIMart, Nano Banana/Gemini, Midjourney-compatible routes, CLO, ET, and others. These names are used only to describe compatibility, user-selected integrations, research references, or payment routes. Looming is not endorsed by, sponsored by, or officially affiliated with those third parties unless a page explicitly states otherwise. Third-party providers may apply their own terms, acceptable-use policies, data retention policies, usage limits, and billing rules.

8. Refunds, Cancellation, and Support

You may cancel paid subscriptions at any time and keep access until the end of the current billing period. Refund requests, duplicate charges, missing credits, or billing questions should be sent to support@looming.cn with your account email and order ID. 9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access, specific generation latency, model availability, provider uptime, queue priority, or permanent access to any particular AI model or integration. The service is provided "as is" without warranties of any kind. We may perform maintenance, updates, quota controls, provider routing changes, safety reviews, or experience downtime beyond our control. We are not liable for any losses resulting from service interruptions, provider failures, model changes, output quality variation, or browser/local-storage limits.

10. Limitation of Liability

To the maximum extent permitted by law, Fashion Node Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

11. Termination

• You may terminate your account at any time by contacting support or through account settings.
• We may suspend or terminate accounts that violate these terms, abuse provider routes or payment systems, attempt to bypass quotas, upload infringing or unsafe material, attack the service, or create legal, security, operational, or reputational risk.
• Upon termination, your right to use the service ceases immediately.
• We will retain your data for 30 days after termination, after which it will be permanently deleted.

12. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
